Anti-social Anti-social behaviour: policy and procedure draft statutory code of guidance

This consultation paper, from the Office of the Deputy Prime Minister, invites views on the draft statutory Code of Guidance for Local Housing Authorities and Housing Action Trusts (HATs). The guidance advises how they should prepare, review and publish their Statements and Summaries of Policies and Procedures in relation to anti-social behaviour.

Purpose of the Code

The Code of Guidance is to assist local housing authorities and Housing Action Trusts (HATs) in England for the purposes of Section 218A(7) of the Housing Act 1996 (inserted by Section 12 of the Anti-Social Behaviour Act 2003). It requires landlords that are local housing authorities, HATs, and registered social landlords to prepare and publish Policies and Procedures in relation to anti-social behaviour ("ASB"). 

Each social landlord must publish a Statement of Policies and Procedures, and an associated Summary, not later than 6 months after the commencement of Section 12 of the 2003 Act. This Code gives guidance on how local housing authorities and HATs ("landlords") in England should prepare and review their policies and procedures in relation to anti-social behaviour. 

The Housing Corporation expects to define its requirements for the contents of anti-social behaviour Policies and Procedures in the same terms as those in the Code of Guidance for Local Housing Authorities and Housing

Action Trusts, where requirements are neutral between different types of landlord.

Guidance Content

Chapter 1 outlines the purpose of the guidance, sets out whom it is for and provides background on the legislative context within which the guidance sits.

Chapter 2 sets out the statutory obligations, which are laid on landlords' under the Housing Act 1996, as introduced by Section 12 of the Anti-social Behaviour Act 2003 and provides advice on how those obligations should be discharged.

Chapter 3 presents the areas of coverage that the landlord's Statement of Policies should contain.

Chapter 4 presents the areas of coverage that the landlord's Statement of Procedures should contain.

Chapter 5 presents the areas of coverage that the landlord's Summary should contain as well as providing information on publication of both the Statement and Summary.
