Police powers to close disorderly and noisy pubs

Pubs and nightclubs that become disorderly could face instant closure for up to 24 hours under new police powers that commenced on the 1 December 2001.

The aim is to encourage landlords to take measures to prevent disorder from occurring on their premises and to prevent serious disturbance to local residents.

The new police powers to close disorderly pubs and nightclubs come under section 17 of the Criminal Justice and Police Act 2001.

Other licensing related measures in the Criminal Justice and Police Act 2001 also coming into force on 1 December are:

  • New powers for the police and local authorities to close premises that sell alcohol without a licence;

  • A positive duty on staff in licensed premises to check the age of young customers before selling alcohol; and

  • Power for police and local authority to enforce the law against under-age alcohol sales by lawfully using minors to make test purchases.
