Motor Salvage Industry Consultation Paper

This consultation is effectively a re-consultation exercise. The Home Office consulted widely in April 2000 on the proposals to regulate the motor salvage industry and received broad support for proposals which have been taken forward in The Vehicles (Crime) Act 2001, which received Royal Assent on 10 April 2001.

This new consultation seeks views on the detail of the regulations to be made under this new legislation.

Proposed measures in Part I of the Act to regulate the motor salvage industry will require operators to:

  • register with the local authority

  • maintain appropriate records of purchases and disposals

  • carry out identification checks of vendors and purchasers

  • allow the police the right of entry to premises and the right of search without warrant.

Documents forming part of the consultation include a Partial Regulatory Impact Assessment and the proposed guidance on the regulations including the proposed regulations themselves. Specific comments are requested on two issues:

  • The length of time operators should be required to keep records

  • The identification to be required by operators from vendors and purchasers

The closing date for responses was 1 March 2002.

Following the consultation, new guidelines were produced by the Home Office. The document provides guidance for the police, local authorities and industry on implementing the provisions of the Vehicles (Crime) Act 2001 relating to the statutory regulation of the motor salvage industry that came into effect on 21 October 2002.

The guidance is non-statutory (i.e. it does not have the force of law), and should not be regarded as authoritative legal advice. If there is any doubt as to the application or interpretation of the legislation, advice should be sought from a legal adviser.
